Cruise passengers calling at Mexican ports are being urged to leave vaping devices behind, after Mexico introduced a nationwide ban on the importation, sale and distribution of vapes and e-cigarettes.
The new law came into force on 17th January 2026, following constitutional reforms approved by Mexico’s Senate in December 2025.
The changes were formally enacted after Mexican President Claudia Sheinbaum Pardo published the amendment to the General Health Law in the Official Gazette of the Federation on 16th January, with enforcement beginning the following day.
Under the reform, any activity connected to electronic cigarettes and vaping devices is now criminalised, including bringing the products into the country through customs.

The legislation significantly expands Mexico’s existing tobacco controls. In 2023, the country introduced a wide-ranging smoking ban covering enclosed public spaces, beaches, parks and public transport, with vaping included in the restrictions.
What Cruise Passengers Need To Know
For cruise guests, the biggest risk arises during the customs process when entering Mexico at cruise ports. Even if a device is intended solely for personal use, bringing it ashore is considered illegal importation under the new law.
This applies to all forms of vaping devices, including disposable vapes, refillable models, pod systems and non-nicotine products. Passengers arriving by air face the same restrictions.
Cruise line Margaritaville at Sea has already issued warnings to guests booked on itineraries that include Mexican ports.
“As of January 16, 2026, Mexico is enforcing a nationwide ban on the importation and sale of vapes and e-cigarettes,
“While private possession within the country may still be legal, the key issue for travelers is entering Mexico through customs—including airports and cruise ports,”
Passengers found in violation of the law risk having their devices confiscated, facing fines of up to $12,500, detention and, in serious cases, prison sentences of up to eight years.
Some travellers have already reported enforcement at entry points. Several cruise passengers have shared online that their vapes were seized upon arrival in Mexico, while others admitted to attempting to conceal devices despite the risks.
Vaping Rules Onboard Cruise Ships
Despite the strict regulations ashore, most cruise lines continue to allow vaping onboard ships sailing to Mexico, provided devices remain on the vessel.
Policies vary by operator, but vaping is typically restricted to designated smoking areas and usually limited to standard tobacco-based products. Guests must also meet minimum age requirements, which for US-based sailings is generally 21.
Cruise lines including Carnival Cruise Line regularly remind guests that onboard policies do not override local laws in ports of call. Passengers are advised to check their cruise line’s rules carefully and avoid taking any vaping devices ashore while visiting Mexico.
